Terms and Conditions 1. Deposit and Payment. The Client shall make a non-refundable dollar deposit to retain the Photographer to perform the services on the date and place specified herein. The Client shall agree to pay balance in full 30 days prior to wedding date Amazing, Inc shall be paid the remaining balance due – of the total agreed upon cost of services to be performed. 2. Cancellation. If the Client cancels wedding date or does not perform wedding on the agreed upon wedding date, liquidated damages for the full amount of contract shall be due and owing from said client. Client agrees that Initial deposit made during period prior to agreed upon wedding date TO BE NON-REFUNDABLE. 3. Photo Materials. A CD or DVD proof containing photo file images too preview can be printed on your own computer, however, quality computer and or commercial photo printing is not guaranteed by Amazing, Inc. A CD or DVD will be presented to the Newlyweds within 4-weeks or more after the agreed upon wedding date. The DVD shall become the property of the Newlyweds and can be used for ordering on-line prints. Custom enlargements and wedding album packages can be purchased at any time by contacting USAmazing.com 4. Copyright & Reproductions. The Photographer shall own the copyrights for the photos created and shall have the exclusive right to make copies of them. The Photographer shall only make copies for the Client or for the Photographer Portfolio, Samples, Self-promotions, Entry in photographic contests or art exhibitions, Editorial use, or for viewing within or outside of the studio. If the Photographer desires to make other uses, the Photographer shall not do so without first obtaining the written permission of the Client. 5. Failure to Perform. If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other causes beyond the control of the parties, if there is an instance of where your photographer is not able to make it to the event, due to a severe traffic tie-up, disaster, sudden sickness, etc, then Amazing, Inc shall 1.) Return to the Client any retainer deposit made prior to the wedding date and shall 2.) Have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that the photos are lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the unlikely event the Photographer fails to perform pursuant to the terms of this Agreement for any other reason, including but not limited to problems with exposure, editing, duplication, or delivery, Photographer shall not be liable for any amount in excess of the retail value of the Client's order. Photographers are not responsible for all the picture requests if time or schedule conflicts due to late wedding parties or individuals of the wedding results in not fulfilling all picture request and in such an instance that there becomes a technical difficulty that results in some pictures being lost from memory damage or any reason full payment of services is non-refundable. 6. Photographer the Photographer may substitute a trusted associate photographer to take the photographs and/or video in the event of Photographer illness or unavoidable scheduling conflicts. In the event of such substitution, Amazing, Inc warrants that the Photographer taking the photos shall be a competent professional able to deliver photographic images of equal quality. 7. Credit. Photographer reserves the right to use company logo, name and any other labeling on the CD/ DVD photo proofs as well as any other packaging . 8. Photographer Standard Price List. The charges in this Agreement are based on the Photographer Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time the order is placed. 9. Table & Seating at Reception. It will be required that the Wedding Party honor said Photographer and or assistants with experience for eating first with the primary wedding party. A place at a nearby table during Reception clearly delineated and set aside for Photographer use to be in close proximity to the Wedding Party and able to capture those memorable moments is requested. (Wedding Invitation must be sent one month prior to wedding date to Amazing, Inc.) 10. Return Policy. Defective DVD may be returned for free replacement for a period up to but not exceeding 2 week from date of receipt by purchaser. After this trial period has expired, the normal fee for said items will be effective pursuant to the Standard Price List & shall not be held responsible for damages from misuse, etc. thereafter. 11. Miscellaneous. This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement.
